IMPORTANT NOTE: Please do not dispose or allow us to remove your current mattress until you have checked the delivery of your new mattress and are happy with the quality of goods. Please ensure you have read these terms and conditions before using your item.

1. Your Order
1.1. You accept The Sleep Shop terms and conditions when you tick “I confirm that I have read and agree to the Terms of Sale” during the checkout process. In confirming this you enter into a binding contract with us, the retailer and you, the customer.
1.2. When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have the right to refuse any order for any reason should we see fit to do so.
1.3. You will be responsible for any information submitted to us throughout the order process and the accuracy of this information given. When requested you will provide us with correct information such as contact numbers and emails as these are necessary to the sale to ensure the delivery is correct and you can be notified throughout the order and despatch process.
1.4. When contacting FGS Furnishings Ltd after point of sale you quote us a billing postcode or order number so we can accurately and efficiently check any enquiries you have
1.5 If we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason we will always notify you and not have to fulfil the order at the incorrect price. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
2. General Sales
2.1. All purchases must be paid in full before despatch. FGS Furnishings Ltd has the right to hold any goods with ourselves until payment has been received and cleared in full.
2.2. Payments are accepted on most credit or debit cards via our secure server; we do not accept American Express. We authorise you to make any enquiries you deem necessary in connection with this sale to aid fraud prevention or debt recovery.
2.3. If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to US Dollars or your own currency.
2.4. All prices quoted are for brand new, manufactured sealed products and are priced in British Sterling Pounds and including VAT.
2.5. Mattress only price includes delivery to any mainland UK address Monday to Friday. Other Furniture will incur delivery fees, these will be automatically added at checkout where the order value is less than £300.00. If an order value is more than £300.00 any delivery charges will be deducted (excludes, pillows/accessories). Additional charges will be incurred for delivery to the Scottish Highlands, Grampians and Northern Ireland.
2.6. Saturday deliveries are possible at an additional cost of £30 dependent on areas available.
2.7. An invoice/ order confirmation giving a description of the goods purchased and the price paid will be emailed to you once the order has been processed internally.
3. Delivery
3.1 Delivery times will depend on the item purchased. Where an item is shown as out of stock, estimated delivery lead times will be displayed on the product page. If an item becomes unexpectedly unavailable, we will contact you as soon as reasonably possible to advise of any delay.
3.2 Items we carry in stock are normally despatched within 24 hours, with delivery aimed for the next working day or a requested date. All delivery dates are estimates only and are not guaranteed.
3.3 All delivery times are subject to stock availability, payment being received and cleared in full, and the accuracy of delivery information provided. Incorrect contact details or addresses may result in delays.
3.4 Wherever possible we will attempt to deliver goods using our own delivery vehicles. However, we reserve the right to use a courier or delivery partner of our choice.
3.5 All delivery dates are given in good faith but are subject to circumstances beyond our reasonable control, including but not limited to weather conditions, traffic incidents, trunking delays, courier capacity issues, supplier delays, or acts of force majeure. We will endeavour to keep customers informed of any delays.
3.6 Customers must inspect goods upon delivery. Where damage is visible, goods should be signed for as “damaged” and refused. We recommend contacting us immediately to allow us to advise on next steps.
3.7 Any damage must be reported to FGS Furnishings Ltd within 24 hours of delivery.
3.8 Our cut-off time for next working day despatch is 3pm (excluding pillows and accessories). Once an order has been despatched, cancellation will incur a return carriage fee of £40, which will be deducted from any refund once goods are returned to our warehouse.
3.9 Pillow orders must be placed by 1pm for next working day despatch.
3.10 Vacuum-packed rolled mattresses must be ordered by 11am for next working day despatch.
3.11 Deliveries to the following postcodes may take longer: AB, BT, DD, HS, IV17-99, KA27, KW, PA20-80, PH33-49 and ZE. Delivery times for these areas may range from 3–14 days.
3.12 We do not deliver outside Mainland UK.
3.13 One-man deliveries are to the ground floor entrance only.
3.14 Two-man delivery is to the room of choice where access is safe and reasonable. Delivery is restricted to no higher than the third floor, with or without lift access.
3.15 Customers must notify us in advance of any access restrictions or delivery difficulties.
3.16 If we are unable to deliver on the arranged date, we will notify you as soon as reasonably possible. In some cases, notification may only be possible on the day of delivery.
3.17 In the event of an unsuccessful delivery attempt, an alternative delivery date will be offered.
3.18 Deliveries do not take place on Sundays or Bank Holidays. Saturday delivery is available at an additional charge.
3.19 Essential delivery dates Delivery dates shall not be considered essential unless expressly agreed in writing by FGS Furnishings Ltd prior to dispatch.
3.20 Limitation of liability for delivery delays Where delivery is delayed but the goods are subsequently accepted by the customer, our liability shall be limited to completing delivery of the goods. We shall not be liable for any indirect, incidental or consequential losses arising from delayed delivery, including but not limited to accommodation costs, alternative purchases, loss of use, loss of enjoyment, or loss of earnings.
3.21 For items not held in stock, delivery estimates are based on information supplied by manufacturers. We shall not be liable for losses arising from extended supplier lead times.
4. Accuracy of Information Provided
4.1. FGS Furnishings Ltd will try to give the most accurate description and representation of the item you will receive and mainly come directly from the manufacturers. If you are unsure or require further information, we advise contacting one of our customer service team.
4.2. The illustrations and colours are representations only but if you would like a swatch of fabrics please contact our customer service team and we will try our best to obtain these for you.
4.3. All sizes and depths are correct according to the manufacturer’s descriptions however there can be slight variations to these and we will make every attempt to ensure these are accurate at the time of buying but we reserve the right to change specifications as advised by manufacturers.
4.4. All items are subject to availability.
4.5. Responsibility for checking the dimensions of your bed or mattress lies solely on you as the customer. This is also applicable for ensuring the mattress will fit in the property and room prior to deliver with ease. FGS Furnishings Ltd cannot be held responsible for customers ordering the incorrect size or not checking the access to property prior to purchase. If you need any clarification to the sizing or accessibility, then please speak to our customer services line prior to ordering.
5. Bed Sizes
5.1. There are no lawful guidelines for sizes of beds that have to be used. The size of the product is used for descriptive purposes but there is no guarantee that it will fit across two different suppliers. For example, a double mattress from one manufacturer may differ in size of the base from another manufacturer. This may predominately be down to the difference between Metric, Imperial and European dimensions.
5.2 Mattresses are made with many individual components such as springs, casing and fillings. It is therefore necessary to allow a tolerance to the width and length of your mattresses, at a guide of an allowance of +/- 1 inch (2.54cm).
5.3. Please be aware that when converted, metric sizes are not exactly the same as imperial sizes. Below are all the sizes of mattresses we sell and beds that fit these sized mattresses:

6. Warranty & Guarantees
6.1. All items supplied by FGS Furnishings Ltd are guaranteed for a minimum period of 12 months. Some products carry longer manufacturer warranties, the details of which will be provided with the product or on request.
6.2. All goods sold by FGS Furnishings Ltd comply with all applicable UK consumer legislation. Nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
6.3. In the unlikely event of a warranty claim, we will provide a standard information request outlining the details, descriptions, and photographs required. Once this information is received, we will liaise with the manufacturer on your behalf to assess the claim.
6.4. With certain manufacturers, charges may apply to warranty claims made after the first 12 months of ownership. Where applicable, any such charges will be clearly explained to you during the warranty claim process and will vary depending on the product and manufacturer.
6.5. In some cases, where the information and images provided do not clearly indicate a manufacturing fault, the manufacturer may require an independent inspection to determine the cause of the issue.
The cost of this inspection may be payable in advance by the customer.
If a manufacturing fault is subsequently confirmed, the inspection cost will be fully refunded, and the claim will proceed in accordance with the applicable warranty.
If no manufacturing fault is found, the inspection cost will not be refundable.
6.6. Where a fault is confirmed within the first six months from delivery, this will be handled in accordance with the Consumer Rights Act 2015. Where a claim is made after six months, the manufacturer or retailer may reasonably require evidence that the fault is due to a manufacturing defect and not wear, misuse, or normal product settlement.
7. Right of Cancellation
7.1 Customers have the right to cancel their order in accordance with the Consumer Contracts Regulations.
7.2 Cancellation must be communicated to FGS Furnishings Ltd in writing, by email, telephone, or post prior to despatch.
7.3 Where goods have been despatched, cancellation is subject to the goods remaining sealed, unused, and in original manufacturer packaging. Items removed from sealed packaging cannot be accepted for return.
7.4 Where goods have been despatched, a return carriage fee of £40 will apply and will be deducted from any refund once goods are received and inspected.
7.5 Requests to cancel or return goods must be made within 14 days of delivery.
7.6 Where delivery is delayed, customers may choose to cancel the order prior to delivery for a full refund of the goods and standard delivery charge.
7.7 Where a customer accepts delivery following a delay, the right to cancel solely due to late delivery no longer applies.

8. Damaged / Disputed Goods
8.1. We will exchange any product that is either damaged or faulty upon delivery, providing we are notified with 24 hours and only when the customer has complied with all our terms and conditions.
8.2. Before processing a damaged goods claim, we will require a photograph of the damaged goods to action the complaint and progress the dispute.
8.3. It is the responsibility of the customer to check the goods have been delivered in good condition and if they are damaged or unchecked to sign as damaged or unchecked.
8.5. If you sign for an item as delivered in good condition and you subsequently notice damage this may affect the right to exchange the item.
8.6. Please contact our Customer Services team within 24 hours of delivery to notify us of any damages with photographic evidence to internetsales@fgsfurnishings.com
9. Refunds
9.1. FGS Furnishings Ltd will refund the purchase price of the goods within 14 days of receiving the goods back in our warehouse and checking the returned goods are sealed and complete minus any return carriage fee (if applicable).
9.2. Customers who refuse delivery at the door will still be liable for a return carriage charge of £40 as the items have been despatched from our warehouse.
9.3. Unfortunately we will not accept a return or process a refund on an item that has been removed from the sealed manufacturers packaging as this becomes classed as a used product.
9.4. FGS Furnishings Ltd must be notified within 14 days of any request to return the item.
9.5. FGS Furnishings Ltd cannot be held liable for items ordered incorrectly, in the incorrect size or unable to fit in the customers property. The responsibility is on the buyer to check this prior to purchase.
10. Sleep Trials
10.1 One mattress exchange is allowed per ordered mattress, limited to an alternative model of the same size.
10.2 Only the original purchaser can request an exchange under the respective sleep trial, with proof of purchase required.
10.3 All trials are only applicable to mattresses that remain within the UK.
10.4 Choose a replacement from our website, aiming to exchange within the same brand whenever possible.
10.5 If the chosen replacement is pricier than the original, we’ll request payment of the price difference by credit or debit card over the phone.
10.6 For replacements priced lower than the original, we cannot refund the difference. However, if the replacement is similar in cost but up to £100 cheaper, we’ll provide the difference by way of a credit to be used against another purchase.
10.7 Original packaging removal is allowed, but the mattress must be returned in a clean, presentable condition.
10.8 Sleep trials do not apply if a mattress protector isn’t used, if the mattress is misused, damaged, repaired, altered, neglected, or shows wear and tear.
10.9 It’s your responsibility to contact us to claim your sleep trial and arrange the exchange.
10.10 Collection and delivery times depend on the availability of your chosen new mattress. If it is stock, delivery can be within a few days; otherwise, we’ll wait for restocking before delivery.
11. Pricing
11.1. All prices shown on the website are inclusive of VAT and a VAT applicable invoice will be emailed to you automatically upon placing your order.

12.1. All details provided to FGS Furnishings Ltd throughout the ordering process will be used to fulfil your order. We will use your details in accordance with GDPR and our privacy policy.
